If you do not agree to this AUP, you must not use, and must immediately discontinue use of, the Services.

Miller Tech Services (“we,” “us,” or “our”) invites you to use our website and related services, including but not limited to managed IT services, consulting, and web hosting services (collectively, the “Services”).

Miller Tech Services may provide web hosting, cloud hosting, virtual servers, application hosting, backups, and related infrastructure services (“Hosting Services”). Hosting Services are provided subject to these Terms and any applicable service agreement, acceptable use policy, or order form.

4.2 Customer Responsibilities

You are solely responsible for:

  • All content hosted, uploaded, or transmitted through your Hosting Services;
  • Ensuring hosted content complies with all applicable laws and regulations;
  • Maintaining current backups unless backup services are explicitly included in your hosting plan;
  • Securing credentials and access to hosted environments.

4.3 Prohibited Content and Use

You may not use Hosting Services to host, store, or distribute:

  • Illegal, infringing, defamatory, or obscene content;
  • Malware, botnets, phishing pages, or exploit frameworks;
  • Content that violates third-party intellectual property or privacy rights;
  • Excessive resource usage that degrades service for others.

We reserve the right to suspend or terminate Hosting Services for violations of this section.

4.4 Availability and Uptime

Hosting Services are provided on a commercially reasonable basis. While we strive for high availability, no hosting service is guaranteed to be uninterrupted or error-free. Scheduled maintenance, emergency maintenance, or events beyond our control may result in temporary service interruptions.

4.5 Data Loss and Backups

Unless expressly stated in writing, Miller Tech Services does not guarantee backups or data retention. You are strongly encouraged to maintain independent backups of all hosted data. We are not responsible for data loss except where required by applicable law.

4.6 Termination

We may suspend or terminate Hosting Services immediately for:

  • Violations of these Terms;
  • Non-payment;
  • Security threats or abuse;
  • Legal or regulatory requirements.

Upon termination, data deletion may occur without recovery unless otherwise agreed in writing.


5. External Sites

The Website may contain links to third-party websites (“External Sites”). These links are provided for convenience only. We do not endorse and are not responsible for the content, accuracy, or practices of External Sites. Accessing External Sites is at your own risk.


6. Compliance with Applicable Laws

This Acceptable Use Policy (“AUP”) governs the use of services provided by Miller Tech Services (“MTS,” “we,” “us,” or “our”), including but not limited to web hosting, cloud services, virtual servers, reverse proxy services, managed infrastructure, and related offerings (collectively, the “Services”).

This AUP is incorporated by reference into our Terms and Conditions and applies to all customers, users, and any party accessing Services through a customer account (“Customer,” “you,” or “your”).


1. Purpose of This Policy

The purpose of this AUP is to:

  • Protect the security, stability, and performance of our infrastructure;
  • Ensure lawful and appropriate use of Services;
  • Define prohibited activities;
  • Establish clear enforcement authority.

Failure to comply with this AUP may result in suspension or termination of Services.


2. Acceptable Use Standards

You agree to use the Services only for lawful, authorized, and intended purposes. You are solely responsible for all activity occurring under your account, including actions taken by users, contractors, or automated systems you control.


3. Prohibited Content and Activities

The following uses are strictly prohibited:

3.1 Illegal or Harmful Content

  • Content that violates local, state, federal, or international law;
  • Fraud, scams, deceptive practices, or impersonation;

3.3 Network and Infrastructure Abuse

  • Denial-of-service (DoS/DDoS) attacks or participation therein;
  • Excessive or abusive consumption of CPU, memory, disk, or network resources;
  • Cryptomining or similar compute-intensive workloads without prior written approval;
  • Circumventing rate limits, firewalls, access controls, or reverse proxy protections.

3.4 Unauthorized Access

  • Attempting to access systems, data, or networks without authorization;
  • Port scanning or penetration testing of MTS or third-party infrastructure without written permission.

4. Hosting, Cloud, and Reverse Proxy Use

4.1 Hosting Responsibilities

Customers are solely responsible for:

  • All websites, applications, and data hosted;
  • Ensuring hosted content is secure, patched, and compliant;
  • Managing credentials and access permissions.

4.2 Reverse Proxy and SSL Services

Where reverse proxy, SSL termination, or similar services are provided:

  • These services are intended for traffic routing and security enhancement only;
  • MTS is not responsible for application-level vulnerabilities or misconfigurations behind the proxy;
  • Abuse or misconfiguration resulting in security risk may result in service suspension.

5. Service Availability (SLA-Lite)

Services are provided on a commercially reasonable, best-effort basis.

  • No uptime, performance, or availability guarantee is provided unless explicitly stated in a separate written agreement;
  • Temporary interruptions may occur due to maintenance, upstream provider issues, security events, automation actions, or circumstances beyond reasonable control.

6. Automation and Provisioning Systems

MTS uses automated systems (including but not limited to Paymenter, Proxmox, and orchestration platforms) to manage Services.

You acknowledge and agree that:

  • Services may be provisioned, modified, suspended, or terminated automatically;
  • Enforcement actions may occur without manual review;
  • Automation errors do not create liability beyond what is stated in our Terms and Conditions.

7. Third-Party Infrastructure

Services may rely on third-party providers, including data centers, transit providers, software vendors, and security platforms.

MTS is not responsible for:

  • Outages, limitations, or policy changes imposed by third parties;
  • Data loss or service disruption caused by third-party failures beyond our reasonable control.

8. Enforcement and Suspension

MTS reserves the right, at its sole discretion, to:

  • Monitor usage to ensure compliance;
  • Suspend or restrict Services immediately if use poses a security, legal, or operational risk;
  • Remove or disable access to offending content.

Where feasible, notice may be provided, but no notice is required where immediate action is necessary to protect systems, customers, or third parties.


9. Termination

Repeated or severe violations of this AUP may result in permanent termination of Services.

Upon termination:

  • Access to Services will cease;
  • Data may be deleted without recovery unless otherwise agreed in writing;
  • Outstanding balances remain due.

10. Limitation of Liability

To the maximum extent permitted by law:

  • MTS is not liable for damages arising from enforcement actions taken under this AUP;
  • Enforcement decisions made in good faith do not constitute breach of contract.

11. Changes to This Policy

We may update this AUP from time to time. Continued use of the Services after changes take effect constitutes acceptance of the revised policy.
